Just got off the phone with Anthony Zinnanti, the lawyer who served a temporary restraining order on Jack McClellan after winning it in Superior Judge Melvin Sandvig's courtroom.

Mr. Zinnanti, who filed for the temporary restraining order along with attorney Richard Patterson, is a saint. He was very easy going, easy to talk to, and he was willing to give me time out of his busy day to discuss the case. I pointed out the freedom of speech issue and Brandenburg v. Ohio, but he says that McClellan already broke the law when he took, and published, photographs of minors without their permission.

I'm not saying that McClellan should go straight to jail, but he does need to be taken off the streets. If therapy and a controlled hospital is the answer, so be it. But he needs to stay the hell away from my daughter.

What law did he break by posting photos of a minor without permission? I'm unaware of such a law. In fact, I thought that taking photos in public places and publishing them is firmly found to be permissible.

Anonymous - first, feel free to leave your name, if you're up for identifying yourself in any way - completely up to you.

Second, my understanding is that publishing any information about a minor, whether a photo or text, that may be seen in an unfavorable light is an actionable offense. Also, if publishing a photo of a minor without consent in a non-newsworthy account is actionable.

I'm not a lawyer, your mileage may vary

The restraining order is invalid. It will never withstand legal challenge. Anthony Zinnanti is using his child to promote his law practice. Shame on him.

Dear I-don't-have-the-balls-to-use-a-real-name-and-email-address,

First, and believe me it was hard to decide which would be first, the restraining order has already withstood legal challenge, as it exists. When a restraining order is applied for, it isn't like getting life insurance at the airport... A judge reviews it. A prosecutor reviews it. The representatives of the bar take an oath to fulfill their duties to the utmost, to not be swayed by personal feelings. So of course it has already been legally challenged.

I believe you mean to suggest that the restraining order against Jack McClellan will not stand *further* or *more extensive* legal challenge. That is certainly up for debate, as our upper-level judicial system is filled to the brim with folks who were bought and paid for by the lobbies of big oil, big tobacco, big guns, etc.

However, let's examine your hypothesis (in which you failed to supply evidence to support your theory) - We have a human here, an adult male who has been unflinching in his pronouncement of his desire to molest little girls. Assuming that these claims are not an elaborate hoax (jury's still out on that one), allow us a moment to break down the essence of this fact: If I have a weapon, say a gun, and it's legally registered and I am in lawful possession of it, I am allowed to keep it at home or at sanctioned locations. I am not allowed to carry it out in public, yelling "Boy, I sure would love to shoot people, I tell you what!" That is against the law, and that law has stood plenty of legal challenge, and has stood strong.

Now, change "gun" to "penis" and "hands" and "shoot people" to "molest little girls" and you've got yourself an incredibly similar ballgame. Do you truly believe that any community would allow a self-acknowledged pedophile to get closer than 30 feet to a minor?

IMO, zinnanti is nothing more than a publicity whore trying to resurrect his failing law practice by stalking and harrassing Mr. McClellan.

Z posts photos of his own teenage daughter on the internet then raises hell when someone links to those pics. He's totally psychotic.

I've had the displeasure of hiring Mr. Zinnanti. Our business relationship didn't last long. He was creepy, verbally abusive and seemed unstable. Total jerk.

I too have had the displeasure of meeting Zinnanti. I would hardly categorize him as the "best, attorney, ever". I agree with the above comment...verbally abusive, totally unstable, and should be reported to the state bar for his abusive behaviours. He lacks all professionalism. IF you are thinking of hiring him DO NOT. There are plenty of professional attorney available for hire!

I have had the PLEASURE of having Mr. Zinnanti represent me in the past and I must say that he is fantastic. Never once have I experienced any verbal abuse, nor has he ever acted unprofessionally. He has always seemed very stable to me. If I ever need to hire an attorney again, I would definitely go back to him.

He is really down to earth and makes you feel like a buddy and at the same time, he gets the job done and does it correctly. I would recommend him in a second.

I suspect anyone who has claimed to be verbally abused by him are probably just poor bitter souls who were on the other side of the case and lost and now want to get some payback by posting about him online. Just my guess and a little strange if you ask me.

Zinnanti took a guy who violated no law, took pictures in public, and used that as a platform to promote himself thanks to his big sister Nancy Grace! Granted McClennan's taste for publishing his thoughts is distasteful, however all Zinnanti did was push him and others further underground.

Zinnanti's standing to file the restraining order is that his teenage daughters were at risk of McClennan. McClennan posted he liked "LGs" (Little Girls), teenage girls are far from Little Girls. In short, Zinnanti used his daughters as a platform to launch himself into the spot light.

Zinnanti has no major published cases, works by himself, and operates out of a little office. To say he is the "Best Attorney" is as true as saying McClennan
likes adult women.

The common bond Zinnanti shares with McClennan is that they each love the spot light.

I apologize for writing so soon after my initial post but saw something I just can't ignore. The initial post states in part, "he [Zinnanti] says that McClellan already broke the law when he took, and published, photographs of minors without their permission." If true this is the pinnacle of stupidity.

A person gives up rights when they walk out their front door. You do not need permission to take a photograph in public. Warren v. Fairfax County, 196 F.3d 186, 191
(4th Cir. 1999) (“The archetypical examples of traditional public fora are streets, sidewalks, and parks.”

Watch TMZ and you will see photographers blocking streets, sidewalks, etc. The age of the person being photographed is irrelevant. Brandenburg v. Ohio is also irrelevant since it deals with defining a threat. This issue pertains to taking a picture in public and the person publishing statements online--which do not come close to a threat since McClennan never spoke to a single kid. (Read the opinion)
